Real Estate Acquisitions & Dispositions

We advise clients on a broad range of real estate acquisitions and dispositions for affordable housing, including fee simple acquisitions and ground leases of vacant land and existing buildings. Our attorneys negotiate complex acquisition and development agreements and affordability covenants with master developers, mission-aligned nonprofits, and state and local governments. We possess broad experience in title and survey review, entitlement approvals including zoning and subdivision, and property owners’ and condominium associations.

Construction

New Communities Law helps clients negotiate prime construction contracts with general contractors and agreements with architects and owners’ representatives. We are familiar with federal, state, and local regulations and investor and lender requirements that affect the construction of affordable housing.

Affordable Housing Finance

Our attorneys have specialized expertise in new construction and rehabilitation of income-restricted multifamily rental projects financed with federal Low-Income Housing Tax Credits, Colorado Affordable Housing Tax Credits, grants and concessionary loans from the Colorado Housing and Finance Authority, Colorado Division of Housing, and local governments, and statutory tax abatements.

Workforce Housing

New Communities Law advises developers on workforce housing projects throughout Colorado. These projects typically include traditional construction and permanent financing but often require project-specific affordability covenants, mission-aligned investor equity, public and philanthropic grants and loans, fee waivers, and tax abatements.

We advise clients on the development and financing of income-restricted homeownership projects. These projects often include traditional and publicly funded construction financing, grants and concessionary loans, affordability covenants, and the formation of homeowners’ and condominium associations.

Our attorneys represent housing authorities and private developers in project-specific partnerships. We advise clients on tax abatements, fee waivers, and rights of first refusal and purchase options.

Property Management and Supportive Services

We help clients negotiate agreements with property managers and service providers. Our attorneys understand the importance of competent property management to achieve regulatory compliance and the role supportive services play in the lives of residents.

Our attorneys advise developers and property owners on HUD programs, subsidies, and loan products.

We advise municipal, county, and multijurisdictional housing authorities throughout Colorado on formation, governance, and policy.
